Limiting Children’s Exposure to Toxicity is a Primary Concern
Buying a new house or condominium usually involves real estate agents, one represents the buyer and one the seller. This arrangement is usually a good one because the both sides have an advocate on their side. The buyer’s agent wants a low price and the seller’s agents wants a high price. When they arrive at a “reasonable” price, the deal is done. If they don’t then the house stays on the market.
With divorce, both parties often retain separate attorneys and the battle begins to “win” the battle. With mediation we don’t approach it as a fight to be won or lost but rather a settling of issues that will see both parties walk away with a fair and peaceful settlement.
When children are involved we seek to accomplish two primary goals. One is that they are not involved in any acrimonious debates about money, visitation, anything that they probably wouldn’t understand and would hurt them. Second, we work very hard to financial and visitation agreements that are fair for both sides, that benefit the children, and don’t have to constantly be amended down the line.
Example: If visitation is established for a set of particular times and dates but job circumstances for one parent change, there should be no reason to fight over changes to the visitation agreement. In mediation we discuss the potentiality of job changes, health issues, changes in other circumstances, and the best way to adjust to them in the future.
Obviously we cannot know the future, but through mediation people learn the art of respectful compromise and how to put the best interests of children first.
