Being prepared is critical because time is limited. While we don’t put a specific time limit on mediation, it’s best not to drag a mediation out over a long time.
Step One: Have a positive attitude about mediation. Mediation has worked for millions of people in every conceivable situation and it will probably work for you.
Step Two: Be willing to listen. This goes along with attitude and is very important. If you want people to listen to you, you have to be willing to listen and learn from others. Mediation is a two-way street.
Step Three: Understand the rules. Take time to discuss the rules with your mediator. This will make the whole process more efficient and will reduce arguments. The rules are usually involve common sense and common courtesy. Also, know how many sessions will take place and the length of each session. Mediation is not supposed to stretch out over months.
Step Four: Have your documents in good order. If you believe you will need printed information to make your point, make sure you have it organized and ready to be viewed. Searching through a box of disorganized receipts, emails, and photographs will slow the process.
Step Five: Have an outcome in mind. You should know what your goals are and be aware of what are the “deal breakers” for your situation. You want to leave a mediation feeling you accomplished something, not that you put yourself in a hole. Be respectful of the other side because they will have goals and deal breakers as well.
